EFAA responds to the EU Commission’s Consultations in the Context of Digital Markets Act (DMA) First Review

In response to the Commission’s Consultation on the review of the DMA (Article 53 of the DMA), EFAA observes that, despite the new obligations, gatekeepers continue to maintain structural dominance, and thus suggests to address structural concentration more directly. On the impact and effectiveness of the DMA, EFAA points out that while the DMA establishes obligations around data access and portability, in practice, SMEs and SMPs still experience barriers. In the Consultation on AI in the Context of DMA Review, EFAA recommends considering obligations for gatekeepers to provide proportionate, secure, and non-discriminatory access to non-personal data so that SMPs/SMEs can also develop competitive AI products and services. It also advocates for stronger safeguards against bundling and self preferencing in AI contexts. See full EFAA response here.
